Guernsey was one of the very first jurisdictions in the world to introduce a comprehensive system for the regulation and supervision of trust and corporate service providers (including company directors).

The relevant Law came into effect on 1 April 2001.

Guernsey has a modern Trust Law and importantly from a client's perspective all trust assets are segregated from other trust assets and creditors of the trustee have no general claim over the trust assets which the trustee is legal owner. There are exceptions in very limited circumstances, such as fraud.

All those engaged in the provision of regulated fiduciary activities in or from within the Bailiwick must apply to the Guernsey Financial Services Commission (GFSC) for a license authorising such activities, requirements include minimum; capital adequacy and professional indemnity insurance.
